The Office of Superintendent of Insurance (OSI) is issuing this bulletin to remind insurers that pursuant to Sections 59A-22-34.3 and 59A-46-38.2 NMSA 1978 each individual and group health maintenance contract delivered or issued for delivery in this state shall provide coverage for childhood immunizations in accordance with the current schedule of immunizations recommended by the American Academy of Pediatrics. The coverage should include all medically necessary booster doses of all immunizing agents used in childhood immunizations. Additionally, coverage for childhood immunizations and necessary booster doses may be subject to deductibles and coinsurance consistent with those imposed on other benefits under the same contract.

The Superintendent also recommends that each health insurer and Health Maintenance Organization providing major medical or comprehensive coverage in New Mexico apply the above criteria related to childhood immunizations to all lines of business.

Questions concerning these directives should be directed to the Life and Health Bureau at life.health@osi.nm.gov.
