This Bulletin repeals and replaces Bulletins Nos. 2003-006 and 2015-008, and any other Bulletin on this same topic issued prior to the date of this Bulletin. This Bulletin is issued in accordance with NMSA 1978, Sections 59A-2-8 and 59A-57-1 through – 11; and 13.10.16 and 13.10.17 NMAC.

The purpose of this Bulletin is to amend the allowable time for the hearing officers and co-hearing officers designated to preside over managed health care hearings.

Hearing officers and co-hearing officers designated to preside over these hearings will continue to be compensated at the hourly rate of three hundred fifty dollars ($350.00) plus New Mexico gross receipts tax.

Hearing officers and co-hearing officers will be compensated for the time they spend working on the grievance inclusive of, but not limited to, preparing for the hearing, presiding over the hearing, engaging in post-hearing deliberations, and issuing a recommendation to the Superintendent, for up to a maximum of eight (8) hours per hearing. If the parties provide written notice of a settlement at least three days prior to the date set for external review hearing, compensation will be unavailable to the hearing officers or ICOs. See 13.10.17.25(C)(4).
