September 12, 2024 Bulletins DATA CALL PURSUANT TO NMSA 1978, SECTION 59A-17-5.1, UNDERWRITING GUIDELINES BULLETIN 2024-016 NMSA 1978, Section 59A-17-5.1(A) allows the Superintendent of Insurance (Superintendent) to “direct an insurer writing homeowners insurance…in New Mexico to file with the Superintendent underwriting guidelines that determine the acceptance of applicants and tiering guidelines that determine the placement of applicants and insured into rating tiers, regardless of whether such tiers exist within the insurer or within a group of insurers under common ownership or management.”The Superintendent is requesting that all insurers that have issued residential property insurance policies covering risks located in New Mexico submit underwriting guidelines in compliance with Section 59A-17-5.1 described above that are effective as of September 1, 2024. All insurers must comply with this request on or before September 30, 2024.
