This Amended Bulletin repeals and replaces Bulletin 2021-014.

UPDATE: Bulletin 2025-006 was originally issued on August 14, 2025. An incorrect copy of the “Notification of Intent to Offer Value-Added Products and Services Filing Instructions and Form” was attached to the bulletin. This Amended Bulletin is being issued with the correct version of the “Notification of Intent to Offer Value-Added Products and Services Filing Instructions and Form.”

Section 59A-16-17 NMSA 1978 clarified provisions related to the prohibition of inducement regarding insurance contracts and provides an exception to the general prohibition of inducement. Under the provisions, an insurer may offer value-added products and services at no or reduced cost, even when such products or services are not specified in the insurance contract, if the criteria described below are satisfied:

Subsection G of Section 59A-16-17 NMSA 1978 specifies criteria that must be satisfied by an insurer to justify offering or providing a value-added product or service:

A value-added product or service may be approved if offered at no or reduced cost, even when such products or services are not specified in the insurance contract, if the product or service:

  1. relates to the insurance coverage;
  2. is offered at a cost that is reasonable in comparison to the insured’s or prospective insured’s premiums;
